Waddington Legal Limited is a firm of solicitors authorised and regulated by the Solicitors Regulation Authority (SRA number 382239). We trade as Foster Law SolicitorsMichael Bower Equine Law, and Waddington Turner Wall Solicitors. This Policy applies to all of them.

Our registered office is 6-12 Devonshire Street, Keighley, West Yorkshire, BD21 2DG.

We are the controller of your personal data and are registered with the Information Commissioner’s Office under reference Z1712649.

2. The personal data we collect

Much of the information we hold for our clients is confidential and subject to legal professional privilege.

Information you are required to provide. We are required by law to verify your identity, and in some cases the source of your funds, before we can act for you. This is part of our anti-money-laundering obligations under the Money Laundering Regulations 2017. If you are unable or unwilling to provide the information we need, we will be unable to take on or continue with your matter.

Our lawful bases for doing this are: performance of our contract with you, compliance with our legal obligations, and our legitimate interests. The specific legitimate interests we rely on are in delivering our legal services, maintaining accurate and complete client files, keeping our systems and information secure, managing our cashflow and billing, promoting our firm and its services, and protecting our firm against claims, complaints and regulatory risk.

Where relevant we also rely on your consent (which you can withdraw at any time) and the “recognised legitimate interests” listed in Article 6(1)(ea) UK GDPR, introduced by the Data (Use and Access) Act 2025, which cover matters such as crime prevention, safeguarding vulnerable individuals, and disclosures to public bodies in the public interest.

Where we process sensitive information (such as health, ethnicity or information about criminal matters), we do so only where a condition under Article 9 or 10 UK GDPR and Schedule 1 of the Data Protection Act 2018 applies.

4. Who we share your data with

Your data is ordinarily held in the UK. Where data is transferred outside the UK (for example, through a cloud service provider or because your matter involves an overseas party), we put in place an appropriate safeguard recognised under UK data-protection law, such as a UK adequacy decision or the UK International Data Transfer Agreement.

6. How long we keep it

We keep your personal data for as long as we need it for the purposes above and to meet our legal, regulatory and insurance obligations. For client matter files, typical retention periods are up to 15 years after the file is closed, and longer for Wills, deeds and similar documents we hold for you. Anti-money-laundering records are kept for 5 years after the end of our relationship. We then securely delete or destroy your data.

7. Cookies

Our website uses cookies and similar technologies. Strictly necessary cookies and certain low-risk cookies (for example, basic analytics) are set automatically in accordance with the amendments to PECR made by the Data (Use and Access) Act 2025. Subject to the conditions and exemptions under UK data-protection law, and to our overriding duties of confidentiality and legal professional privilege, you have the right to:

9. How to make a complaint

If you are a client and are not satisfied with our response, or if we have not resolved your complaint within eight weeks, you may refer it to the Legal Ombudsman (legalombudsman.org.uk, 0300 555 0333). Complaints must be made to the Legal Ombudsman within six months of our final response and within one year of the act or omission you are complaining about, or within one year of you realising there was a problem.

If your concern is specifically about your personal data, you can also complain to the Information Commissioner’s Office (transitioning to the Information Commission under the DUAA) at ico.org.uk or 0303 123 1113.

We may update this Policy from time to time. The “Last updated” date at the top shows when it was last revised.
